Terms of Service

1. Who we are and what this is

Wing James (wingjames.com) is run by JTM Media LLC ("we," "us"). It lets a person looking to date (a "Seeker") offer a reward (a "bounty") to anyone (a "Wingman") who introduces them to someone (a "Match") they go on a first date with.

The bounty pays for the introduction. It is never payment for a date, for anyone's time or company, or for any personal or intimate activity, and the Match is never paid. Anyone who uses Wing James to arrange or offer paid companionship, sexual activity or escort services will be removed and may be reported.

We are a platform that connects people. We are not a dating agency, matchmaker or party to any date, and we don't run background checks.

2. Agreeing to these terms

By using Wing James, including introducing someone, approving an introduction, recording a vouch or creating an account, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the site.

We may update these Terms. If we make a material change, we'll post the new version here and update the date above, and where we have your email we'll let you know. Continuing to use Wing James after a change means you accept it.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use Wing James in any role. You may only introduce people who are 18 or older. You may not use Wing James if you've been removed from it before or are barred from using services like it under applicable law.

4. Accounts

You log in with a code sent to your email. Keep access to your email secure; anyone who can read it can log in as you. You're responsible for activity on your account. Tell us right away at hello@wingjames.com if you think someone else has accessed it.

Introductions are tied to the email address you enter. Only use an email address that belongs to you.

5. Introducing someone (Wingmen)

When you introduce someone, you promise that:

• the person knows you're introducing them and is open to it;
• they're 18 or older;
• you have the right to share the photos and information you submit, and the photos are of them;
• everything you submit is accurate and isn't misleading, hurtful or explicit.

The person you introduce is sent a private link and decides whether to go ahead. Nothing about them is shown to the Seeker until they approve. If they decline, their photos and details are deleted.

You may not introduce the same person to the same Seeker twice, submit introductions in bulk, or introduce people as a business without our written permission. You can have up to three open introductions with each Seeker at a time.

6. Being introduced (Matches)

If someone introduced you, you choose whether to approve. You can edit what they wrote before approving, and only the approved version is shown to the Seeker. When you approve, you agree to these Terms and confirm you're 18 or older.

The contact details you give are shared with the Seeker only if the Seeker says yes. You're never charged and never paid. You can ask us to delete your information at any time.

7. Seekers, bounties and payments

Seekers set a bounty for a first date. When a Seeker says yes to an approved introduction, they're charged the bounty, a service fee of 5% of the bounty, and a card processing fee. That money is held, and released or refunded under these rules:

• If the Seeker confirms the date happened, the bounty is released to the Wingman.
• If the Match confirms the date happened and the Seeker doesn't respond within 7 days, the bounty is released to the Wingman.
• If no date is confirmed within 30 days of the Seeker saying yes, the Seeker is refunded in full.
• If the Seeker says no date happened and the Match hasn't confirmed one, the Seeker is refunded in full.
• If the Seeker and the Match disagree, the money stays held while we look into it. We may ask both sides for information and our decision is final.

The Wingman receives the full bounty. We keep the service fee. The service fee and card processing fee are not refundable except when the Seeker is refunded.

Payments are processed by Stripe. Wingmen receive payouts through a Stripe account and must agree to Stripe's terms, including the Stripe Connected Account Agreement, and complete Stripe's identity checks. We don't store card numbers, bank account numbers or Social Security numbers.

Seekers who save a card authorize us to charge it for the bounty, service fee and processing fee each time they say yes to an introduction.

We may hold, delay or reverse a payout if we reasonably believe an introduction or a date confirmation was fraudulent, or if a charge is disputed with the card issuer.

8. Wingmen are independent

Wingmen are independent individuals, not our employees, agents or contractors. You're responsible for any taxes on what you earn. Stripe may send you a tax form (such as a 1099) if you earn above the reporting threshold.

9. Vouch videos

If a Seeker asks you to record a vouch, you choose whether to do it. By uploading a vouch, you confirm it's you in the video and agree that the Seeker may publish it on their Wing James page. The Seeker approves vouches before they go live and can remove them at any time. Ask the Seeker or us to take your vouch down whenever you like.

10. Content you share

You keep ownership of the photos, videos and text you submit. You give us a non-exclusive, worldwide, royalty-free license to host, store, display, resize and convert them only as needed to run Wing James, including showing a Seeker's page and its link previews. This license ends when the content is deleted, except for copies kept in backups for a limited time or where we must keep them by law.

You may not upload content that is sexually explicit, violent, hateful, harassing, illegal, or that shows someone without their permission. We can remove any content and any account that breaks these Terms.

11. Safety

Meet in public, tell a friend where you'll be, and trust your instincts. We don't verify identities beyond what Stripe requires for payments, and we don't screen anyone for criminal history. You're responsible for your own safety and conduct with people you meet. If someone makes you feel unsafe, contact local authorities first, then tell us at hello@wingjames.com.

12. Things you may not do

• Use Wing James for paid companionship, sexual services or any illegal purpose.
• Impersonate anyone or submit someone without their knowledge.
• Harass, threaten or abuse anyone you meet or contact through Wing James.
• Collect other people's information, scrape the site or use bots.
• Try to get around payments, for example by arranging the bounty off the platform after an introduction.
• Interfere with the site's security or operation.

13. Ending your use

You can stop using Wing James at any time and ask us to delete your account. We may suspend or remove any account that breaks these Terms or puts others at risk. Money already held is handled under the payment rules above.

14. Disclaimers

Wing James is provided "as is" and "as available." We don't promise that any introduction will lead to a date or a relationship, that the information people share is true, or that the site will always be available or error-free.

15. Limit on our liability

To the fullest extent the law allows, JTM Media LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for anything arising from your interactions with other people, on or off Wing James. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $100.

16. Indemnity

You agree to cover JTM Media LLC's reasonable costs, including legal fees, from claims that arise from content you submitted, your conduct with other people, or your breaking these Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Utah, except that either side may bring a claim in small claims court if it qualifies.
